ARRESTED!?!?! NOW WHAT!

If you’ve been arrested for a crime, you probably have a lot of questions about what comes next. At Donley Law Firm, defending clients and guiding them through the criminal process is what we do!

The First Step 

So, what happens after you’ve been arrested? The first step is usually an initial hearing or first appearance court. This is where a judge will tell you what you were arrested for. Next, the judge will give you a bond so that you can bond out if you are able. After that, the judge will determine if you qualify for a public defender. If you qualify for the public defender, you can still hire your own attorney if you like. If you do not qualify for the public defender, you must hire an attorney if you want an attorney to help you. Lastly, they will give you the next court date that you are to appear in court.

Court Hearings and Pre-Trial Conferences

Every court date after first appearance court is an opportunity for the prosecutor and your attorney to meet and discuss the case. Additionally the judge gets updates on how the case is progressing. This is not the only time your attorney and the prosecutor meet but the other times is either on the phone or via email. Depending on the county, the judge may allow for your attorney to appear on your behalf without you being present.

The Case’s Resolution

Ultimately, a criminal case will end up one of two ways. The first is through a trial. In a trial there can be a jury or just in front of a judge. Each side makes their case, and a verdict is delivered.

The second option is through an agreement with the State. This might mean a diversion program, or it might mean that certain charges will be dismissed in exchange for a guilty plea, or the entire case can be dropped. It all depends on the facts of the case.
